These Terms & Conditions (“Terms”) are an agreement between you and Pari Luxe Aesthetics Inc., doing business as Pari Med Spa (“Pari Med Spa,” “we,” “us” or “our”). They govern your use of our website and your booking and purchase of our services, packages and gift cards. By using our website, booking an appointment or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website or services.

Please read carefully: these Terms require you to resolve disputes with us through final and binding individual arbitration, and you waive your right to a jury trial and to take part in any class action. See Section 13.

1 · Medical disclaimer

• Information only. Content on this website, including descriptions, FAQs, videos, blog posts and chat responses, is for general information only. It is not medical advice, diagnosis or treatment, and it is not a substitute for an in-person consultation with a licensed provider.
• No provider-patient relationship. Using this website, submitting a form, chatting or messaging us does not create a provider-patient relationship. That relationship begins only after an in-person consultation and your acceptance as a patient.
• Licensed care. Treatments are performed by or under the direction of Dr. Parvina Ibragimova, DNP, FNP-BC, a New York licensed nurse practitioner, using professional clinical judgment.
• Candidacy. Every treatment requires an evaluation. We may decline, delay or modify any treatment in our clinical judgment.
• Results vary. Results differ from person to person based on anatomy, health, lifestyle, age and adherence to aftercare. Timelines, numbers of sessions and how long results last are estimates, not promises. We do not guarantee any specific result. Dissatisfaction with an aesthetic outcome is not grounds for a refund. Touch-ups, if offered, are at our clinical discretion.
• Before & after photos show individual results of real clients or illustrative examples and are not a guarantee that you will achieve the same results.
• Risks. All aesthetic and medical treatments carry risks, which are explained to you before treatment in a written informed consent. Your signed consent forms govern your treatment. By proceeding with treatment, you confirm that these risks were explained to you, that you had the opportunity to ask questions, and that you voluntarily choose to proceed.
• Emergencies. Our website, email, chat and text messages are not monitored for emergencies. If you have a medical emergency, call 911 or go to the nearest emergency room.

2 · Your responsibilities

You agree to provide complete and accurate information about your health, medical history, medications, allergies, pregnancy and prior treatments, and to follow all pre-treatment and aftercare instructions. You understand that inaccurate or incomplete information, or not following instructions, can affect your safety and results. You must be at least 18 years old to book services, and we may require government-issued photo ID to verify your age and identity.

3 · Appointments and cancellations

• 48-hour notice. Please cancel or reschedule at least 48 hours before your appointment.
• $75 no-show and late cancellation fee. Missed appointments (no-shows), and cancellations or reschedules with less than 48 hours’ notice, are subject to a $75 fee, which you authorize us to charge to the payment method on file.
• Late arrivals may result in a shortened treatment or a rescheduled appointment, and may be treated as a late cancellation.
• Misrepresentation. If you provide false or incomplete health information, or arrive under the influence of alcohol or drugs, we may cancel your appointment and charge the $75 fee plus the cost of any product already prepared or opened for your treatment.
• Right to refuse service. We may refuse, stop or end service to anyone who is abusive, harassing, threatening or unsafe toward our staff or other clients, or whose treatment we believe is not in their best interest.
• No recording. To protect the privacy of our clients and staff, photos, video or audio recording of staff, other clients or treatment areas are not permitted without our consent.
• We may need to reschedule appointments due to provider availability or circumstances beyond our control. We will notify you as early as possible.

4 · Pricing, payments and packages

• Prices shown on our website are for general information, may change without notice and are confirmed at your consultation. Your final price depends on your treatment plan, such as the number of units or syringes used.
• Payment is due at the time of service unless agreed otherwise. Payments are processed through Square, and you authorize us and Square to charge your selected payment method.
• Packages and series are for the named client only, are non-transferable and have no cash value.
• All sales are final. Packages, series, services rendered and products are non-refundable, including unused or partially used sessions, except where required by law. If you become medically ineligible to continue a package, we may, at our discretion, convert unused sessions to an in-office credit for another service.
• Payment disputes. Your payment and your signed consent form confirm that you received the services charged. Please contact us at support@parimedspa.com before disputing any charge so we can resolve it. Disputing a charge for services you received is a breach of these Terms, and you authorize us to share your signed consent forms, treatment records, appointment history and photographs with the payment processor and card issuer as needed to respond to the dispute.
• Financing is provided by independent third parties under their own terms. We are not a lender and are not responsible for financing decisions.

5 · Gift cards and promotions

Gift cards are issued in accordance with New York General Business Law §396-i, are not redeemable for cash except where required by law and are not replaced if lost or stolen. Promotions cannot be combined unless stated, have no cash value and may be changed or ended at any time.

6 · Text messages

Our text messages are sent through Square. By providing your mobile number, you agree to receive appointment confirmations, reminders and service-related texts from Pari Med Spa. Promotional texts are sent only with your prior express written consent, which is not a condition of purchase. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

7 · Website use

You agree not to use our website for any unlawful purpose; to submit false information or book under someone else’s name; to interfere with the website’s security or operation; or to copy, scrape or misuse its content. We may restrict or end access for anyone who violates these Terms.

8 · Intellectual property

All website content, including text, photographs, before & after images, videos, logos and design, is owned by Pari Luxe Aesthetics Inc. or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, distribute or use any content without our written permission. Product names such as Botox^®, Daxxify^®, Xeomin^®, SKINVIVE™, Kybella^® and Morpheus8^® belong to their respective owners, who do not endorse this website.

9 · Third-party services

Booking, payment, financing, gift card, chat and social media services are provided by third parties under their own terms. We are not responsible for their content, availability, errors or practices.

10 · Disclaimer of warranties

The website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the website will be uninterrupted, error-free or free of viruses. Pricing, availability and service descriptions may contain errors, which we may correct at any time.

11 · Limitation of liability

To the fullest extent permitted by law, Pari Med Spa, its owners, providers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of or reliance on this website or its content. Our total liability for any claim relating to the website, products, gift cards, bookings or billing will not exceed the amount you paid us for the specific item giving rise to the claim. Nothing in these Terms limits liability for professional negligence, gross negligence or willful misconduct, or any other liability that cannot be limited under New York law.

12 · Indemnification

You agree to defend, indemnify and hold harmless Pari Med Spa, its owners, providers, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys’ fees, arising from your misuse of the website, your violation of these Terms, or false or incomplete information you provide to us.

13 · Governing law and arbitration

These Terms are governed by the laws of the State of New York and the Federal Arbitration Act, without regard to conflict-of-law rules.

• Informal resolution first. Before starting any claim, you agree to contact us at support@parimedspa.com and try to resolve the dispute informally for at least 30 days.
• Binding arbitration. Any dispute, claim or controversy arising from or relating to these Terms, our website, products, gift cards, bookings, payments or billing will be resolved exclusively by final and binding arbitration, not in court. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and will take place in Richmond County, New York, or by video conference if both parties agree. Judgment on the award may be entered in any court with jurisdiction. Claims arising from medical treatment are governed by your signed consent forms and any separate written agreement you sign with your provider.
• Individual claims only. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not consolidate claims of more than one person. If this class action waiver is found unenforceable for any claim, that claim must be decided by a court, not an arbitrator.
• Waiver of jury trial. You and Pari Med Spa each waive the right to a trial in court and the right to a jury trial.
• Court orders. Either party may ask a court for an injunction or other urgent relief to stop misuse of its intellectual property, content or confidential information, without waiting for arbitration.
• Small claims. Either party may instead bring an individual claim in small claims court in Richmond County, New York, if it qualifies.
• 30-day opt-out. You may opt out of this arbitration agreement by emailing support@parimedspa.com with your name and the words “Arbitration Opt-Out” within 30 days after you first accept these Terms. Opting out will not affect any other part of these Terms.
• Time limit. To the extent permitted by law, any claim relating to the website, products, gift cards, bookings or billing must be started within one year after it arises. This time limit does not apply to claims arising from medical treatment.

14 · General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver, and any waiver must be in writing. We are not liable for delays or closures caused by events beyond our reasonable control, such as severe weather, power outages, public health emergencies or government orders. We may assign these Terms in connection with a sale or transfer of our business; you may not assign them without our written consent. Any feedback, reviews or suggestions you send us may be used by us without restriction or payment. These Terms, together with our Privacy Policy and any consent forms you sign, are the entire agreement regarding their subject matter; your signed treatment consent forms control for matters of treatment. We may update these Terms at any time by posting a new version on this page, and your continued use of our website or services means you accept the changes.
